Agreement is a binding condition between you and General Buyers.

General Buyers is a trademark owned by URAS India.
The trademarks, logos and service marks displayed on this site are registered
under common law Trademarks of URAS India. Nothing contained on this site
should be construed as granting, by implication, or otherwise, any license or
right to use any of the Trademarks without the written permission of URAS
India.
We shall not be liable for indirect, special, or
consequential damages (or any loss of revenue, profits, or data) arising in
connection with this Agreement or the Program, even if we have been advised of
the possibility of such damages
License
We grant you a limited & non-exclusive license
only for:
- Viewing
the pages contained on the Site;
- Creating
& Posting Enquiry using the tools available on the site.
- Participate
in competitive bidding through the services and means provided by the
website.
The applicability of this limited license is
subject to and conditioned on the terms and conditions of this Agreement. This
license terminates if you violate any terms and conditions of this Agreement.
This license is non transferrable to any other person or party.
General Terms
- The
consumer and the supplier should be at least 18 years or above to use the
General Buyers website.
- General
Buyers is not a traditional Auctioneer. It is created for the benefit of
the common consumers to purchase products at the cheapest market rate
through online reverse auction, also referred to as “On demand Reverse
Auction”.
- This
website is meant for purchase of new branded electronic products only.
- This
website allows consumers to post enquiry of the products that he intends
to purchase. The enquiry is circulated to the suppliers of the specific
product. General Buyers is a platform wherein suppliers participates in
competitive bidding to decide “Best price of the product” through a reverse auction-style event
commonly referred to as "reverse online auctions".
- A consumer is defined as the person / party
who has registered themselves as “Consumer” with General Buyers website.
- A supplier is defined as the person / party
who has registered themselves as “Supplier” with General Buyers website.
- All
products are Cash On Delivery.
- All
suppliers are classified as either Local or Outstation, depending on the
location of the supplier.
- No user is allowed to Disclose the Bidding
price in Public / or using it for the purpose of negotiation in open
market..
- It is
the sole responsibility of consumer and supplier to ascertain the product
specification and any guarantee / warranty. associated with the
product. General Buyers only acts as a mediator between consumer and
supplier, hence we do not undertake any responsibility for guarantee /
warranty claims.
- General
Buyers do not undertake any responsibility if any wrong information is
provided either by consumer or by supplier
- Any
dispute arising between consumer and supplier has to be resolved by the
two parties on their own. General Buyers will not be a part of the dispute
in any form.
- Any
product that is illegal or banned in the country according to the code of
law shall not be sold through General Buyers.
- Consumer
and supplier (party) using the General Buyers website shall under no
condition are using the website to undertake any activity that is not
legal under the law of the land. If either party uses the website for any
such activity then General Buyers shall not be held
responsible for any such action, the onus of the entire action would rest
on the parties concerned.
Consumers
- The
reverse auction service offered by General Buyers is Free of Cost for
Consumers.
- Inquiries once floated, the consumer shall
have to purchase the product if at least 2 suppliers participate & a
total of at least 3 bids are submitted by the end of auction.
- On
finish of an auction event, the consumer has to raise the automated
Purchase Order through General Buyers website only within 48 hours from
the time of finish of auction.
- Non
compliance of the above 2 clause might result in suspension and or
termination of user ids.
- General
Buyers shall notify the consumer only about the least bid supplier
details.
- Consumer
has the right to cancel an order if the supplier do not meet the
requirement completely.
- All the
products shall be Cash On Delivery
- All
products come with Goods Delivery Form (GDF). This form should be filled
during delivery of product and a copy of it should be handed over to the
delivery person (this process ensures that the product delivered is in
good condition).
- Consumers
are not allowed to disclose the prices received during the bidding process
to any other supplier or consumer.
- Consumer’s
userid is non transferrable.
- Consumers
are not allowed to use an alias to place false bids.
- General
Buyers reserves the right to suspend a userid without providing any
justification.
Suppliers
· Registration
- Registration
in General Buyers is free of cost for all Suppliers
- Supplier
should only register for the category and location that they will be able
to deliver at Cash on Delivery.
- Supplier
has to provide all the necessary documents & information (as specified
in “Supplier Registration” Section) to
General Buyers in order to qualify as a valid supplier for the selected
product range.
- All the
valid Suppliers are considered as same. General Buyers do not accept any
money or influence to provide preference to any supplier.
- General
Buyers reserves the right to suspend a userid without providing any
justification
- Supplier’s
userid is non transferrable
- General
Buyers also allow Internet based retailers to register and participate in
the auction process
· Bidding
- Supplier
will receive all inquiries pertaining to the category that they have
registered with General Buyers.
- Depending
on the supplier’s base location, supplier will be either considered as a
local or an outstation supplier for a specific enquiry.
- If a
Supplier bid for any enquiry, It will be considered that they will be able
to supply the exact product mentioned in the enquiry
- Your
bidding price should be the Final price (Total Transaction Price), i.e.
inclusive of all taxes, delivery & handling cost. This amount shall be
payable to you by the Consumer during delivery.
- Supplier
will be notified only if they are the least bidder of a particular
enquiry.
- Bids
once submitted are irrevocable and cannot be modified. We request
suppliers to be extra cautious while submitting the bids.
- All the
Bids shall have a validity of minimum 14 days from the day of finish of
auction.
- Winning
of Reverse auction event is not a binding and may not result in confirmed
order.
- Submission
of false bid for any reason can result in suspension of supplier’s user
id’s from any further participation in General Buyers website in future.
Delivery
- All the
products shall be Cash On Delivery.
- All
products shall be delivered on receipt of the Purchase Order (from
Consumer) within 7 days from the day of issue of Purchase Order.
- Supplier
will carry 2 copies of Goods Delivery Form (GDF). After delivery, this GDF shall be filled by Consumer. One copy each
of GDF shall be retained by Consumer and Supplier (this process ensures
that the product delivered is in good condition). Please read the Cash On
delivery section for more details.
Warranty
All the products should be brand new and provided
with original equipment manufacturers (maker’s) Warranty (if any)
Payment
- There’s
no cost for Registration & Bidding process.
- The Supplier has to pay a percentage of the
total transaction price to General Buyers when a Purchase Order is issued
to the supplier against an enquiry. The Payment slab is as below:

Additional service tax and education
cess amounting to 12.36% on “General Buyers Fees”
Illustration:
Final price of a camera is Rs 9000 (amount
payable to supplier by consumer)
- General Buyers Fees @ 5% of 9000 = 450
- Service tax @12% of 450 = 54
- Education cess @3% of 54 = 1.62
- Total tax = 54 + 1.62 = 55.62, i.e. 12.36% of 450
Total fees payable to General Buyers by Supplier
= 450 + 55.62 = 505.62
Any modification in Indian service tax
and education cess percentages shall be updated as and when applicable.
Supplier shall pay the General Buyers fees within
10 days from the day of issue of Purchase Order (from Consumer).
Non payment of fees within the given timeframe may
result in immediate termination of user ids with General Buyers and subject to
legal action.
Cash On Delivery (COD)
- All products should be accompanied with a valid "RETAIL BILL".
- It is
the sole responsibility of Supplier to choose a logistics provider of his
own choice to carry out the Cash On Delivery of product. General Buyers do
not recommend or insist any specific Logistic Provider for shipments.
- Suppliers
should avoid Logistics Provider services for Local deliveries. Suppliers
should preferably arrange their own transportation and hand over the
product directly to Consumer for Local city shipments.
- General
Buyers provide COD facility for all its users and it is agreed that the
agreement for transportation of goods through a Logistic provider shall be
strictly between the Supplier and the Consumer only. At no time shall any
right, title or interest over the items be associated with General Buyers
nor shall General Buyers have any obligations or liabilities in respect of
such agreement.
- General
Buyers is not responsible for unsatisfactory or
delayed performance of services or damages or delays as a result of
services provided by Logistic Provider to Supplier.
- Supplier
shall not hold General Buyers responsible for any dispute between him and
Logistic Provider with respect to any transaction.
- Once
the General buyers Consumer have raised a purchase order for the product,
Supplier shall be mandatorily required to print 2 copies of Goods Delivery
Form (GDF). Both the copies of GDF should be handed over to Logistics
Provider along with the respective consignment.
- After
Consumer makes payment and gets possession of the product, both the copies
of GDF should be filled by Consumer in presence of Logistics provider. One
copy each should be retained by Consumer and Logistics provider
respectively. The Logistics provider should hand over this GDF to Supplier
later. It is the responsibility of Supplier to make necessary arrangements
with the Logistics provider to ensure that the filled GDF’s are returned
back to Supplier. GDF is meant for future reference and its retention is a
binding condition for Suppliers.
Termination
- General
Buyers may terminate this Agreement along with terms and conditions and/or
the provision of any of the services at any time for any reason, including
any improper use of this portal without providing any justification. This
may not affect any right to relief to which General Buyers may be
entitled, at law or in equity. Upon termination of this User Agreement and
these terms and conditions, all rights granted to you will terminate and
revert to General Buyers.
Amendments
- General
Buyers may at any time amend or modify this terms and conditions and your
usage of this website will be governed by the terms and conditions in
force at the time of your use.
Dispute
- If any
dispute arises between General Buyers and consumer / supplier (all
collectively as party) hereto during the subsistence of this Agreement or
thereafter, the Parties hereto shall endeavour to settle such dispute
amicably. In the case of failure by the Parties to resolve the dispute in
the manner set out above within 30 (thirty) days from the date when the
dispute arose, the aggrieved party may refer such dispute to arbitration
in accordance with the Arbitration and Conciliation Act, 1996. The place
of arbitration shall be in Jamshedpur. Any action arising out of or in
connection with such arbitration proceedings shall be subject to the
jurisdiction of Jamshedpur Courts only.
- If any
party (consumer / supplier) fails to perform its obligations under this
Agreement, such party shall be deemed to have breached this Agreement and
in the event, the breach continues for 5 (five) days despite giving
written notice to breaching party, the non-breaching party, shall have
liberty to exercise its rights and remedies as available under this
Agreement and under the Law.
